The Enugu State Governorship Election Petition Tribunal has dismissed both Labour Party, LP, and Peoples Redemption Party, PRP, allegations against the Enugu State Governor, Dr. Peter Mbah of the Peoples Democratic Party.
Both parties had petitioned the Tribunal alleging that Dr. Peter Mbah’s National Youths Service Corps, NYSC, certificate was forged hence his candidature should be disqualified.
But the Tribunal on Thursday ruled that the allegations of the PRP governorship candidate Mr. Christopher Agu could not be proved by the petitioner; Christopher Agu’s petitions against Governor Mbah are on forged NYSC certificate, corruption, and plea bargain.
Also struck out was the LP Governorship candidate- Chijioke Edeoga’s application against Governor Mbah on the grounds that the NYSC certificate according to section 177 of the 1999 constitution is not a requirement for contesting the governorship election.
The Tribunal holds that Dr. Peter Mbah is qualified to run the election with or without an NYSC certificate and as such did not submit his NYSC certificate to INEC as a prerequisite to contest for the office of a governor.
The Justice Akano-led tribunal also struck out Edeoga’s allegations of over-voting and bypass of BVAS stating that witnesses called by the petitioners could not specify the polling units affected nor present the results of those units as claimed.
Delivering the judgment, Chairman of the Tribunal, Justice Kudirat Akano affirmed that Dr. Peter Mbah is the duly elected governor of the state as the petitioners failed in all charges against him.
“On the issue of plea bargain, the petitioner failed to provide the certified true copy and we concluded that the petitioner should prove the issue of plea bargain by presenting the true certified copy of the bargain.
“On NYSC certificate forgery; the absence of a certified true copy of NYSC certificate made the submission of petitioner inadmissible.”
The Tribunal further averred that to prove forgery, both the original and the supposedly forged certificate ought to have been presented as exhibits.
