The petitions filed by the Labour Party and its presidential candidate, Peter Obi, before the Presidential Election Petition Court sitting in Abuja challenging the victory of the president-elect, Bola Tinubu at the February 25, 2023, presidential election has slated 10th May 2023 for the continuation of the pre-hearing session.
Five political parties including Action Alliance (AA), Allied Peoples Party (APP), Labour Party (LP), Allied People’s Movement (APM), and Peoples Democratic Party (PDP) have filed petitions seeking the nullification of the election of Bola Tinubu of APC.
In their petitions, the parties are seeking the panel to nullify the election of Tinubu over alleged irregularities and non-compliance with the Electoral Act 2022, particularly the transmission of results from BVAS to IREV or order a rerun.
The Court before the adjournment heard the petition filed by the Labour Party and its Presidential candidate Peter Obi against INEC, President-elect Bola Tinubu, his Vice Kashim Shetima, and the APC.
Also adjourned to the same date was the petition by the Action Peoples Party APP, against Tinubu, APC, and the Independent National Electoral Commission.
The adjournment was at the instance of the panel, following the filing and adoption of pre-hearing processes by various counsels for the petitioners.
Lead counsel to the petitioners, Dr. Livy Uzoukwu informed the court that all questions had been answered and filed accordingly as contained in the prehearing Form on the 22nd of April 2023.
After submission by the parties, Justice Haruna Tsammani, Chairman five-member of the Panel of Justices, adjourned the hearing until Wednesday this week.
Other members of the panel are Justice Stephen Adah, who is the presiding Justice of the Asaba Division of the Court of Appeal, Justice Misturat Bolaji-Yusuf, Justice Boloukuromo Ugo, and Justice Abba Mohammed.
Justice Tsamani, in his opening remarks, said the Court should be addressed as the Presidential Election Petition Court and not a “Tribunal“ and warned against sensational statements for the safety of the country.”
The Presidential Election Petitions Tribunal has warned lawyers and political parties to avoid sensational comments for the peace and safety of the country.
