A Magistrate’s Court sitting in Wuse Zone 6, Abuja, has ordered the police to investigate Senator Francis Fadahunsi over alleged comments in which he called on supporters to kill members of the Accord Party ahead of Saturday’s Osun State governorship election.
The Presiding Magistrate II, Farida Ibrahim, directed the Assistant Inspector-General of Police, Zone 7, Abuja, to investigate the criminal complaint and submit its findings to the court within two weeks.
The directive was contained in a letter dated 13 August 2026, signed by the Registrar of the Magistrate’s Court, Abdulraham Yusuf.
The letter, titled “Direct Criminal Complaint Between Pelumi Olajengbesi and Senator Francis Fadahunsi,” was issued pursuant to Section 89(5) of the Administration of Criminal Justice Act, 2015.
The court attached a copy of the complaint to the letter and directed the police to take “necessary action”.
It stated: “I am directed by the presiding Magistrate II, His Worship Hon. Farida Ibrahim, sitting at Magistrate Court Wuse Zone 6, F.C.T Abuja to write to your office to investigate the above-mentioned case and report back within two weeks.”
The complaint was filed by Pelumi Olajengbesi, spokesman for the campaign supporting Governor Ademola Adeleke’s re-election, following the circulation of a video purportedly showing Fadahunsi making the controversial remarks.
In the video that has since gone viral on social media, Fadahunsi, an All Progressives Congress (APC) senator, spoke in Yoruba and allegedly called on his supporters to lynch members of the Accord Party.
“From now on, whenever you see Accord members, kill them. I authorise you to kill them. They have wives and children too,” Fadahunsi had said.
The video triggered backlash, with critics accusing the senator of inciting violence against political opponents at a time of heightened tension ahead of the 15 August election.
Fadahunsi subsequently attempted to distance himself from the interpretation of the remarks, saying his words had been misunderstood.
His team said the statement was not a call for physical violence but a political appeal to voters to defeat the Accord Party at the polls.
In a statement titled “Kill Osun Accord with Votes, Not Violence,” the senator’s team said his comment was “a call on supporters to overwhelmingly reject the Accord Party at the ballot box through lawful, peaceful and democratic means during the August 15 governorship election”.
“For the avoidance of doubt, the Senator’s statement was purely political and metaphorical,” his team said.
The clarification, however, has not stopped the legal challenge, as the Magistrate’s Court has directed the police to investigate the complaint.
The police investigation came a day after Olajengbesi threatened to institute a ₦10 billion defamation and injurious falsehood suit against Fadahunsi over separate allegations made during television interviews.
In a letter dated 12 August, Olajengbesi’s lawyer, Hammed Lasisi, demanded the immediate retraction of statements allegedly made by Fadahunsi during interviews on Viable TV on 2 July and Channels Television’s Politics Today on 11 August.
According to the lawyer, Fadahunsi accused Olajengbesi of sponsoring thugs and members of the Eiye and Aye cult groups.
The lawyer stated: “During the said interview, you launched a direct attack on the identity, character and reputation of our Client by stating, among other things, that our Client was ‘not even from the same Ijebu-Jesha’ and was ‘from somewhere in Ogun State.’ You further accused him of ‘using thugs, Eiye and Aye.’”
The lawyer further alleged that Fadahunsi said during the 11 August Politics Today interview: “Rogba is an Eiye man sponsored by Barr. Olajengbesi terrorising the whole … my own territory up and down through all these Eiye and Aye.”
Olajengbesi denied the allegations and described them as false, defamatory and injurious to his reputation.
“The allegation of sponsoring cultists and persons engaged in acts of terror is particularly serious, as it imputes criminality and conduct wholly incompatible with our Client’s standing as a legal practitioner, public figure and candidate for elective office,” the lawyer stated.
Olajengbesi also denied ever sponsoring, financing, supporting, or patronizing any cult group or its members for criminal or political activities.
His lawyer demanded that Fadahunsi retract the alleged defamatory statements through the same media platforms on which they were made and issue an “unequivocal and unreserved public apology”.
The senator was given 24 hours to comply, failing which Olajengbesi threatened to commence legal proceedings seeking ₦10 billion in general and aggravated damages for defamation and injurious falsehood.
The controversy comes amid repeated allegations of political violence in the run-up to the Osun election.
Adeleke, who is seeking re-election under the Accord platform, has repeatedly accused the APC of deploying thugs to attack and kill his supporters.
The APC has denied responsibility for violence and has also accused the ruling camp of attempting to create fear ahead of the poll.
