The All Progressive Congress Party, APC, on Tuesday filed an originating summons against the Independent National Electoral Commission, Prof. Mahmood Yakubu, Barrister Festus Okoye and Dr. Chukwuemeka Joseph Chukwu in the Federal High Court of Nigeria.

Joining the 17 political parties in Enugu in the suit, the plaintiff claims for Declarations, Injunction and Orders against the above four defendants as concern possible violation of the electoral acts 2022 in collation of the 2023 gubernatorial elections in Enugu state.

“WHETHER by the combined interpretation of the express provisions of Section 64(4) (5) (6) (7) (8) of the Electoral Act 2022, the 1, 2nd, 3rd and 4th Defendants’ Returning Officers/Collation Officers are mandatorily required to COLLATE and ANNOUNCE the result of the Enugu State 2023 Governorship Election held on 18/3/2023 at the Wards, Local Governments and State Collation levels.”

“WHETHER by the combined interpretation of the express provisions of Section 64(4) (5) (6) (7) (8) of the Electoral Act 2022, the failure of the 1, 2, 3 and 4th Defendants’ Ward Collation Officers/Returning Officers to collate and announce the ward result of the Enugu State Governorship Election held on 18/3/23 in each of the 260 Wards in Enugu State is a violation of the Electoral Act, 2022.”

“Weather by the combined interpretation of the express provisions of section 64(4)(5)(6)(7)(8) of the Electoral Act, 2022, the failure of the 1st, 2nd, 3rd, and 4th Defendants Local Government Collation Officers/Returning Officers to collate and announce the result of each Local Government in the 2023 Enugu State Governorship Election held on 18/3/2023 in each of the Seventeen (17) Local Government Areas in Enugu State is a violation of Election Act, 2022”

“AN ORDER setting aside the 4th Defendants acts and decisions of collation and announcement of some Ward and Local Government results of the Enugu State Governorship election in Enugu collation level without first and foremost collation and announcement by the 1st, 2nd, 3rd and 4th Defendants’ Ward and Local Government collation officers/returning officers at the ward and Local Government Collation levels.”

Meanwhile, protesters have besieged INEC office in Independence Layout Enugu because of the suspension of collation and announcement of result.

The protesters who were carrying posters of the People Democratic Party gubernatorial candidate maintain they will not stop until results are called and Peter Mbah declared winner.
