The Election Tribunal sitting in Enugu on Tuesday dismissed the petition filed by the Action Democratic Party (ADP) seeking to stop the swearing in of Dr. Barr. Peter Ndubuisi Mbah, as the Enugu State Governor on Monday 29th May 2023.

The Tribunal in its ruling citing section 285 subsection 2 of the 1999 constitution said it lacks jurisdiction to delve into issues outside its constitutional mandate and on that note dismissed the petition.

Speaking to newsmen after the ruling, Council to ADP, Alex Amujiogu described the ruling as very unfortunate and revealed intention to appeal the case.

“The Tribunal in their wisdom have given out their ruling as regards the motion I filed to stop the swearing in of Dr. Peter Mbah on certain factors;”

“They only stopped at the angle of jurisdiction but even the Supreme Court made it important that even if a court lacks jurisdiction, that does not prevent such from delving into the issues at stake,” Amujiogu stated.

Amujiogu further expressed hope to get justice for his party; “We still have hope; we will go to Appeal to rectify what was done wrong in the Tribunal.”

Four petitioners including the ADP and her Governorship candidate Nnamdi Omeje prayed the Tribunal to cancel the March 18 Governorship election held in Enugu.
