The Court of Appeal sitting in Enugu on Tuesday dismissed the Enugu APC Gubernatorial candidate Mr. Uche Nnaji’s appeal filed against Governor Peter Mbah of Peoples Democratic Party, PDP.
The Court of Appeal upheld the decision of the Enugu Governorship Election Tribunal to dismiss Nnaji’s appeal against Peter Mbah and 6 others in the March 18 governorship election.
The APC gubernatorial candidate’s appeal had challenged the qualifications of the People’s Democratic Party (PDP) candidate and 6 others; it was however dismissed by the Enugu Governorship Election Petition Tribunal for lack of service of petitioners reply and the dismissal upheld by the Court of Appeal.
However, Uche Nnaji, the All Progressives Congress, APC, Enugu state and supporters are unrelenting in pursuit of Justice in Enugu as they move to appeal to the Supreme Court of Nigeria.
Supporters of the APC Enugu Gubernatorial candidate expressed deep disappointment with the rulings stating that the case should have been allowed to proceed on its merits rather than being dismissed on procedural grounds.
Mr. Nnaji’s legal team and supporters believe that the case was dismissed unfairly and prematurely thereby denying them the opportunity to present their arguments and evidence in support of their claims.
“The petition was validly filed within the designated timeframe, and any delays in serving the respondents should not have been attributed to them but the court registry,” APC Enugu legal team asserts.
Expressing concerns on the broader implications of the Appeal Court’s ruling against APC on procedural grounds rather than examining the substantive merits, the legal team says the ruling sets a worrisome precedent which will discourage candidates from exercising their right to legal redress in future elections.
Undeterred by the outcome, Uche Nnaji’s supporters have vowed to continue their fight for justice thus suggesting intention to explore other legal avenues to contest the Court of Appeal’s decision.
