The people of Ajuona Obukpa Autonomous Community in the Nsukka Local Government Area of Enugu State have sued the University of Nigeria, Nsukka, demanding ₦100m damages for alleged degradation of their environment.

The community in suit No N/86/2020 before a Nsukka Division of the Enugu State High Court, asked the court for a perpetual injunction to restrain the university from continuing the construction of its 11,900-room hostel, which was the cause of the problem.

The suit was filed by one Nnaemeka Aleke for himself and on behalf of the Ajuona Obukpa Autonomous Community. It has the UNN and Viagem Property and Investment Limited as defendants.

The residents in a statement of claim filed on behalf of the plaintiffs by their lawyer, C.I Odo, claimed that “the ongoing hostel construction project being carried out by the UNN has created erosion menace in Ajuona Obukpa community, destroying houses, roads, land and becoming a source of mosquito infestation that has now given room for malaria as a common sickness in the community.”

“The plaintiff avers that the roads leading into and out of Ajuona Obukpa Community are devastated.”

The statement further read, “The plaintiff…sought an order of the court directing the 1st and 2nd defendants to stop forthwith the building of the 11,900-room hostel capacity until they control the erosion devastating lives and properties in the Ajuona Obukpa Autonomous Community.

“An interlocutory injunction restraining the defendants, particularly the second defendant forthwith, from the construction of the 11,900 rooms hostel capacity being constructed on the premises of the first defendant or any other construction work in the university pending the hearing and determination of the substantive suit.

“An order of the court awarding damages of N100,000,000 only, against the defendants jointly and severally in favour of the plaintiff and his community for the injuries they have suffered over the years as a result of the nuisance created by them.” The case has been fixed for April 13.
