The Court of Appeal in Abuja has ordered the Academic Staff Union of Universities (ASUU) to call off its over seven months strike.

The National Industrial Court of Nigeria (NCIN) had last month directed the striking lecturers to return to the classroom.

Justice Polycarp Hamman, in a ruling delivered on 21 September, restrained ASUU from continuing with the strike pending the determination of a suit filed by the federal government to query the legality of their strike action.

However, the union, dissatisfied with the ruling, headed to the Appeal Court to challenge the NCIN’s decision.

At the court session on Friday, the appellate court said ASUU should obey the order of NCIN which directed the suspension of the strike before seeking to appeal the judgment.

“I am inclined to granting the application to appeal the decision of the National Industrial Court of Nigeria. But the order of the lower court shall be immediately obeyed,” the court held in its unanimous ruling.

The ruling was delivered by a three-man panel led by Justice Hamma Barka.

The court gave ASUU seven days within which to file its notice of appeal against the order of the NCIN. It insisted that for ASUU to file it’s notice of appeal within seven days, it must show evidence that it’s members have resumed work, effective from Friday, 7 October.
