The Abuja division of the Federal High Court has granted the Advertising Regulatory Council of Nigeria, ARCON, leave to serve a writ of summons on Meta, the parent company of Facebook.

A writ of summons is an official order for someone to appear in a court of law when they have been accused of committing an offence against someone.

Meta is the first defendant in the suit, and AT3 Resources Limited is the second defendant.

ARCON filed a lawsuit against the company for the violation of the extant advertising laws of Nigeria.

ARCON accuses Meta of publishing various advertisements and marketing communications materials via its social media platforms, Facebook and Instagram which violates the regulatory body’s advertising standards.

ARCON argues that such ads are not in tandem with the Nigerian culture, constitutional tenets, moral values and religious sensitivity of Nigerians and as such are illegal.

The regulatory body, therefore, is seeking an injunction restraining the defendants, their agents and associates from running an ad or marketing communications material without recourse to ARCON in line with the country’s advertising law.

It is also seeking a fine of N30 billion for the continued violations and infractions of the Advertising Regulatory Council of Nigeria’s Act No. 23 of 2022 by the defendants.
